ALLGEMEINE GESCHÄFTSBEDINGUNGEN (AGB)

1. Geltungsbereich
1.1. Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Bestellungen, die Sie als Verbraucher (nachfolgend "Kunde") über den Online-Shop Jadenbree (nachfolgend "Shop") aufgeben.
1.2. Anbieter und Vertragspartner ist:
Hubert Wolanski, Garibaldistr. 25, 13158 Berlin, Deutschland (nachfolgend "Anbieter").
1.3. Abweichende Bedingungen des Kunden werden nicht anerkannt, es sei denn, der Anbieter stimmt ihrer Geltung ausdrücklich zu.
2. Vertragsschluss
2.1. Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot, sondern eine Aufforderung zur Bestellung (invitatio ad offerendum) dar.
2.2. Durch das Anklicken des Bestellbuttons ("Kaufen" / "Zahlungspflichtig bestellen") gibt der Kunde ein verbindliches Angebot zum Kauf ab.
2.3. Der Anbieter bestätigt den Eingang der Bestellung per E-Mail (Eingangsbestätigung). Der Kaufvertrag kommt erst mit Versand einer separaten Auftragsbestätigung oder Versandbestätigung zustande.
2.4. Die Vertragssprache ist Deutsch. Englische Texte werden zur Information bereitgestellt.
3. Preise und Zahlung
3.1. Alle Preise sind Endpreise in Euro und enthalten die gesetzliche Mehrwertsteuer.
3.2. Versandkosten werden zusätzlich berechnet und im Bestellprozess vor Abschluss der Bestellung angezeigt.
3.3. Der Anbieter bietet folgende Zahlungsmöglichkeiten an (je nach Verfügbarkeit im Checkout): Kreditkarte, PayPal, Shopify Payments sowie weitere im Shop angezeigte Methoden.
3.4. Die Zahlung ist sofort bei Bestellabschluss fällig.
4. Lieferung und Versand
4.1. Die Lieferung erfolgt durch unseren Fulfillment-Partner Printful. Printful produziert und versendet die Produkte direkt an den Kunden.
4.2. Lieferzeiten sind Schätzwerte und hängen von Produktionszeit und Versandweg ab. Typische Lieferzeiten:
- Deutschland: ca. 5-10 Werktage
- EU: ca. 7-14 Werktage
- Weltweit: ca. 10-20 Werktage
4.3. Der Anbieter ist nicht verantwortlich für Verzögerungen, die durch Printful, Zollbehörden oder externe Versanddienstleister verursacht werden.
4.4. Es wird weltweit geliefert. Für Lieferungen ausserhalb der EU können Zollgebühren oder Einfuhrsteuern anfallen, die der Käufer trägt.
5. Widerrufsrecht
5.1. Als Verbraucher steht Ihnen ein gesetzliches Widerrufsrecht zu. Näheres entnehmen Sie bitte der gesonderten Widerrufsbelehrung, die Bestandteil dieser AGB ist.
5.2. Vom Widerrufsrecht ausgenommen sind Waren, die nach Kundenspezifikation angefertigt oder eindeutig auf die persönlichen Bedürfnisse zugeschnitten wurden (mass-gefertigte oder personalisierte Produkte). Die im Shop angebotenen Produkte sind standardisierte Print-on-Demand-Artikel und daher grundsätzlich widerrufbar, sofern sie nicht individuell personalisiert wurden.
6. Gewährleistung und Mängelrüge
6.1. Es gelten die gesetzlichen Gewährleistungsrechte. Der Anbieter haftet für Sach- und Rechtsmängel nach den geltenden gesetzlichen Vorschriften, insbesondere den Vorschriften des BGB über den Kaufvertrag.
6.2. Bei offensichtlichen Mängeln, insbesondere Druckfehlern oder Transportschäden, ist der Kunde gebeten, den Anbieter unverzüglich zu kontaktieren und Fotos des Mangels bereitzustellen.
6.3. Da die Produkte durch Printful hergestellt werden, behält sich der Anbieter vor, Ansprüche gegen Printful geltend zu machen. Dies berührt nicht die Ansprüche des Kunden gegen den Anbieter.
7. Haftungsbeschränkung
7.1. Der Anbieter haftet für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit sowie für vorsätzliche und grob fahrlässige Pflichtverletzungen.
7.2. Im Übrigen ist die Haftung des Anbieters auf den vertragstypischen, vorhersehbaren Schaden beschränkt.
7.3. Die Haftung für leicht fahrlässige Verletzung unwesentlicher Vertragspflichten ist ausgeschlossen.
8. Urheberrecht und Eigentumsrecht an Designs
8.1. Sämtliche im Shop angebotenen Designs, Grafiken und Kunstwerke sind urheberrechtlich geschützt. Das Eigentum an diesen Rechten verbleibt beim Anbieter bzw. den jeweiligen Lizenzgebern.
8.2. Der Erwerb eines Produkts gewährt dem Käufer kein Recht zur gewerblichen Nutzung, Vervielfältigung oder Weiterverwertung der enthaltenen Designs.
9. Online-Streitbeilegung (OS) und Verbraucherstreitbeilegung
Wir sind nicht bereit und nicht verpflichtet, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
10. Anwendbares Recht und Gerichtsstand
10.1. Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts (CISG).
10.2. Für Verbraucher innerhalb der EU gilt ergänzend das zwingende Verbraucherschutzrecht des jeweiligen EU-Mitgliedstaats, in dem der Verbraucher seinen gewöhnlichen Aufenthalt hat.
10.3. Gerichtsstand für Kaufleute und Personen ohne allgemeinen Gerichtsstand in Deutschland ist Berlin.
11. Salvatorische Klausel
Sollten einzelne Bestimmungen dieser AGB ganz oder teilweise unwirksam sein oder werden, bleibt die Gültigkeit der übrigen Bestimmungen unberührt.

GENERAL TERMS AND CONDITIONS (T&Cs)

1. Scope of Application
1.1. These General Terms and Conditions (T&Cs) apply to all orders placed by you as a consumer (hereinafter 'Customer') via the online shop Jadenbree (hereinafter 'Shop').
1.2. The provider and contracting party is:
Hubert Wolanski, Garibaldistr. 25, 13158 Berlin, Germany (hereinafter 'Provider').
1.3. Any deviating terms and conditions of the Customer shall not be recognised unless the Provider expressly agrees to their validity.
2. Conclusion of Contract
2.1. The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order (invitatio ad offerendum).
2.2. By clicking the order button ('Buy' / 'Order with obligation to pay'), the Customer submits a binding offer to purchase.
2.3. The Provider confirms receipt of the order by email (order acknowledgement). The purchase contract is only concluded upon the Provider sending a separate order confirmation or dispatch confirmation.
2.4. The language of the contract is German. English texts are provided for information purposes only.
3. Prices and Payment
3.1. All prices are final prices in euros and include statutory VAT.
3.2. Shipping costs are charged separately and are displayed during the ordering process before the order is completed.
3.3. The Provider offers the following payment methods (subject to availability at checkout): credit card, PayPal, Shopify Payments, and other methods shown in the Shop.
3.4. Payment is due immediately upon completion of the order.
4. Delivery and Shipping
4.1. Delivery is handled by our fulfilment partner Printful. Printful produces and ships the products directly to the Customer.
4.2. Delivery times are estimates and depend on production time and shipping route. Typical delivery times:
- Germany: approx. 5-10 business days
- EU: approx. 7-14 business days
- Worldwide: approx. 10-20 business days
4.3. The Provider is not responsible for delays caused by Printful, customs authorities, or external shipping service providers.
4.4. Worldwide delivery is available. For deliveries outside the EU, customs duties or import taxes may apply, which are borne by the buyer.
5. Right of Withdrawal
5.1. As a consumer, you are entitled to a statutory right of withdrawal. Please refer to the separate Withdrawal Policy, which forms part of these T&Cs.
5.2. The right of withdrawal does not apply to goods that are manufactured according to customer specifications or clearly tailored to personal needs (bespoke or personalised products). The products offered in the Shop are standardised print-on-demand items and are therefore generally subject to the right of withdrawal, unless individually personalised.
6. Statutory Warranty
6.1. Statutory warranty rights apply. The Provider is liable for material and legal defects in accordance with the applicable statutory provisions, in particular the provisions of the German Civil Code (BGB) on contracts of sale.
6.2. In the case of obvious defects, in particular printing errors or transport damage, the Customer is requested to contact the Provider without delay and to provide photographs of the defect.
6.3. As products are manufactured by Printful, the Provider reserves the right to assert claims against Printful. This does not affect the Customer's claims against the Provider.
7. Limitation of Liability
7.1. The Provider's liability is for damages arising from injury to life, limb, or health, as well as for intentional and grossly negligent breaches of duty.
7.2. Otherwise, the Provider's liability is limited to the foreseeable damage typical of the contract.
7.3. Liability for slightly negligent breaches of non-essential contractual obligations is excluded.
8. Copyright and Ownership of Designs
8.1. All designs, graphics, and artworks offered in the Shop are protected by copyright. Ownership of these rights remains with the Provider or the respective licensors.
8.2. The purchase of a product does not grant the buyer any right to commercial use, reproduction, or further exploitation of the designs contained therein.
9. Online Dispute Resolution (ODR) and Consumer Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
10. Applicable Law and Jurisdiction
10.1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
10.2. For consumers within the EU, the mandatory consumer protection law of the EU member state in which the consumer has their habitual residence shall additionally apply.
10.3. The place of jurisdiction for merchants and persons without a general place of jurisdiction in Germany is Berlin.
11. Severability Clause
Should individual provisions of these T&Cs be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
